Legal Process & Law Enforcement Request Policy

How JHBRIDGE Translation Services responds to legal process requests, law enforcement inquiries, and government data requests while balancing user privacy.

Our Approach

JHBRIDGE Translation Services ("JHBridge," "we," "us," or "our") respects the privacy of its users and is committed to protecting the personal information and data entrusted to us. We recognize that our clients rely on us to handle their documents, communications, and account information with care and discretion, and we take that responsibility seriously in all contexts, including when responding to legal process and law enforcement requests.

JHBridge will only disclose user information in response to valid legal process or in limited emergency situations as described in this policy. We carefully evaluate each request we receive to determine whether it is legally valid, properly scoped, and appropriately directed to JHBridge. We balance our obligation to comply with applicable law against the privacy interests of our users, and we will push back on requests that we believe are overbroad, insufficiently justified, or otherwise improper.

This policy describes JHBridge's general practices for handling legal process requests and is intended to provide transparency to our users. Nothing in this policy creates any enforceable right or obligation beyond what is required by applicable law. JHBridge reserves the right to modify its practices as circumstances require and as applicable law evolves.

Valid Legal Process Required

JHBridge requires a valid subpoena, court order, search warrant, or other legally sufficient request before disclosing user data to law enforcement, government agencies, or third parties in legal proceedings. We do not voluntarily disclose user information in response to informal requests, verbal inquiries, or communications that lack proper legal authority, except in the limited emergency circumstances described in this policy.

Requests for user information must be issued by a court or authority with jurisdiction over JHBridge or the user whose information is sought. Requests issued from jurisdictions without applicable authority over JHBridge, or requests that do not conform to the procedural requirements of the issuing jurisdiction, may be declined or challenged. JHBridge is located in Massachusetts, United States, and generally requires requests to comply with U.S. law and applicable state law.

JHBridge will not treat a legal process request as valid merely because it appears to be issued by a government entity or law enforcement agency. We review each request for proper form, legal sufficiency, scope, and jurisdiction before making any disclosure. If a request is deficient, we may seek clarification, object, or decline to comply until a proper request is received.

Types of Legal Process

JHBridge recognizes several forms of legal process through which user information may be requested. A subpoena (whether grand jury subpoena or civil subpoena) may be used to compel production of limited non-content records, such as basic account information, billing records, and service dates. JHBridge evaluates subpoenas for proper form and scope and may object to subpoenas that are overly broad or seek content that should require a higher standard of legal process.

A court order issued under applicable law may compel production of records specified by the court, which may include non-content records and, depending on the legal standard met, certain additional categories of information. Search warrants issued by a court upon a showing of probable cause may be used to compel production of content and comprehensive records, including the contents of documents, communications, and stored files. JHBridge generally requires a warrant for the disclosure of content data.

Other legally binding orders, including national security letters, orders issued under the Foreign Intelligence Surveillance Act (FISA), and other compulsory legal instruments, will be evaluated on a case-by-case basis in consultation with legal counsel as appropriate. JHBridge will comply with valid orders while seeking to protect user privacy to the fullest extent permitted by law.

User Notification

JHBridge believes that users should be informed when their information is sought through legal process, and we will make reasonable efforts to notify affected users of legal process requests when we are legally permitted to do so. Notification allows users the opportunity to seek legal advice, challenge the request, or take other steps to protect their interests.

If JHBridge is prohibited from providing notice to the affected user -- for example, by a court order, a non-disclosure order, a gag order, or applicable law -- notice may be delayed or omitted as required. In such cases, JHBridge will comply with the prohibition on notice and will provide notice to the user at the earliest time permitted, if applicable. JHBridge may also seek to have non-disclosure orders lifted or narrowed where we believe such orders are unnecessary or overly restrictive.

Notification to users will generally include a description of the type of legal process received and the categories of information sought, to the extent that such disclosure is permitted. JHBridge is not responsible for providing legal advice to users and recommends that users consult their own legal counsel if they have questions or concerns about a legal process request affecting their account.

Data Preservation

JHBridge may preserve user data upon receipt of a valid preservation request from law enforcement or another authorized entity. Preservation requests ask JHBridge to retain a snapshot of specified user data for a defined period of time pending the issuance of formal legal process. JHBridge will comply with valid preservation requests to the extent required by applicable law.

Preservation of data does not constitute disclosure of that data. Preserved data is maintained in its existing state and is not released to the requesting party until JHBridge receives valid legal process compelling disclosure. Preservation prevents the routine deletion of data that might otherwise occur under JHBridge's standard data retention and deletion practices during the preservation period.

Preservation requests are generally honored for a period of 90 days, subject to extension upon receipt of a renewed preservation request or formal legal process. JHBridge reserves the right to reject preservation requests that are incomplete, lack proper authority, or seek preservation of data that JHBridge does not possess. JHBridge will maintain the confidentiality of preservation requests to the extent required by applicable law.

Rejection of Improper Requests

JHBridge may reject, object to, or seek to narrow legal process requests that are overly broad, vague, legally insufficient, issued without proper authority, abusive, or otherwise deficient. We believe that legal process should be targeted and specific, and we will not comply with requests that amount to fishing expeditions or that seek information far beyond what is reasonably necessary for the stated purpose of the request.

JHBridge may seek to challenge or quash requests that appear disproportionate, that seek information unrelated to the stated investigation or proceeding, that do not comply with procedural requirements, or that raise significant privacy concerns. Where appropriate, JHBridge may consult with legal counsel and may file motions to narrow or oppose legal process that we believe is improper or overreaching.

JHBridge's decision to reject or challenge a request does not constitute a refusal to comply with valid legal process. If a court or other authorized body determines that a request is valid after JHBridge has raised objections, JHBridge will comply with the resulting order as required by law. JHBridge's goal is to ensure that user information is disclosed only in response to proper, legally valid, and appropriately scoped requests.

Emergency Disclosure

JHBridge may voluntarily disclose user information without formal legal process when JHBridge believes in good faith that an emergency involving imminent danger of death or serious physical injury to any person requires immediate disclosure. Emergency disclosures are exceptional measures taken in exigent circumstances where the delay involved in obtaining formal legal process could result in serious harm.

Emergency disclosure requests should clearly describe the nature of the emergency, the specific information sought, the basis for believing that disclosure is necessary to prevent imminent harm, and the relationship between the requested information and the emergency situation. JHBridge will evaluate emergency requests on a case-by-case basis and will exercise its discretion in determining whether the circumstances warrant disclosure without formal legal process.

Emergency disclosures are made at JHBridge's sole discretion and in compliance with applicable law. The fact that JHBridge has made an emergency disclosure in one case does not obligate JHBridge to make disclosures in other cases. JHBridge will limit emergency disclosures to the information reasonably necessary to address the imminent threat and will document the basis for each emergency disclosure for its records.

Jurisdiction

Legal process directed to JHBridge should be issued by courts or authorities with jurisdiction over JHBridge Translation Services, located in Braintree, Massachusetts, United States. JHBridge operates under the laws of the Commonwealth of Massachusetts and the United States, and legal process should comply with applicable federal and state procedural requirements.

JHBridge may decline to comply with legal process issued by courts or authorities in jurisdictions that do not have authority over JHBridge or that conflict with U.S. law. International legal process requests should be submitted through appropriate channels, such as mutual legal assistance treaties (MLATs) or other internationally recognized mechanisms for cross-border legal cooperation.

Nothing in this policy is intended to waive any jurisdictional objections or defenses that JHBridge may have in connection with legal process served upon it. JHBridge reserves all rights to challenge jurisdiction, venue, or the propriety of service in any proceeding related to legal process requests.
